These Terms of Service ("Terms") govern your access to and use of Verbo Speak and related services (collectively, the "Service") operated by Overmind Dominion LLC ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be legally bound by these Terms.

If you download the Service through the App Store operated by Apple Inc., you acknowledge:

• These Terms are between you and Overmind Dominion LLC, not Apple.
• Apple is not responsible for the Service or its content.
• Apple has no obligation to provide support or maintenance.

If you do not agree, you must discontinue use immediately.

You must:

• Be at least 18 years old; or
• Have verified parental/guardian consent if under 18.

• Provide accurate information and maintain account security.
• Be responsible for all activity under your account.
• Acknowledge that we reserve the right to suspend or terminate accounts that violate these Terms or pose legal, security, or operational risks.

Verbo Speak is an AI-enhanced augmentative and alternative communication (AAC) platform designed for accessibility and educational use.

Features may include:

• AI-powered sentence refinement
• Voice synthesis
• Cloud synchronization
• Symbol communication boards
• Administrative dashboards

We may modify, suspend, or discontinue any feature at any time without liability.

You may use the Service only for lawful, personal, educational, or accessibility purposes.

You may NOT:

• Reverse engineer or attempt to access source code
• Circumvent security mechanisms
• Use AI features to create unlawful, harmful, abusive, or infringing content
• Attempt unauthorized data extraction or scraping
• Use the Service for unapproved commercial exploitation
• Interfere with platform integrity or other users

Violation may result in immediate termination.

New users may receive a 30-day free trial of premium features.

• No charges apply unless you subscribe.
• Trial access automatically expires.
• We reserve the right to modify or revoke trial eligibility.

Subscriptions are processed through your device's app store.

Plans may include:

• Monthly
• Yearly
• Lifetime (where available)

All pricing and renewals are managed by the applicable app store.

You may cancel at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.

Refunds are governed solely by app store policies.

The Service includes artificial intelligence features.

You acknowledge:

• AI outputs may contain inaccuracies
• AI responses are provided "as-is"
• AI is not medical, legal, therapeutic, or safety advice
• You are solely responsible for how AI outputs are used

We are not liable for reliance on AI-generated content.

The Service is designed to support accessibility needs and aligns with the principles of the Americans with Disabilities Act (ADA).

However:

• The Service is not a medical device.
• No therapeutic outcomes are guaranteed.

For users under 13:

• Verified parental consent is required before account activation.
• Parent/guardian must provide verified email and digital affirmation of authority.
• Accounts are activated only after consent verification.
• Parents may review or request deletion of minor data.

Failure to obtain required consent results in denied access.

All intellectual property rights in the Service, including software, AI models, symbol libraries, branding, and design, are owned exclusively by Overmind Dominion LLC.

No ownership rights are transferred to users.

DMCA notices may be submitted to legal@overminddominion.com.

Your use of the Service is subject to our Privacy Policy.

Security controls include:

• Encryption in transit (TLS)
• Encryption at rest (AES-256)
• Role-based access controls
• Audit logging
• Incident response procedures

We design controls consistent with SOC-2 security principles; however, certification status may vary.

We do not guarantee uninterrupted access.

The Service may be suspended or unavailable due to:

• Maintenance
• Third-party service outages
• Infrastructure failures
• Security events
• Force majeure events

We are not liable for temporary service interruptions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• UNINTERRUPTED OPERATION

USE IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:

These limitations apply regardless of legal theory.

You agree to indemnify Overmind Dominion LLC against any claims, damages, or costs arising from:

• Your use of the Service
• Your breach of these Terms
• Your infringement of third-party rights
• Content you create, upload, or transmit

Any dispute first requires good-faith negotiation between the parties.

If unresolved after 30 days, disputes shall be resolved through binding arbitration under JAMS rules.

• Arbitration is conducted individually (no class actions).
• Arbitration is governed by applicable law.
• Each party bears its own legal fees unless applicable law requires otherwise.

We may suspend or terminate your account without notice if you:

• Violate these Terms
• Engage in unlawful activity
• Pose a security or operational risk

Upon termination, your access ceases immediately. Data deletion is governed by our Privacy Policy.

These Terms are governed by the laws of Arizona without regard to conflict of laws principles.

This choice of law shall not apply if it would violate applicable law.

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement.

We may modify these Terms at any time. Continued use constitutes acceptance of changes.

If any provision is invalid, the remaining provisions remain in effect.
